The holder of a breeder’s rights has the exclusive right to use the varieties with the granted plant variety rights under Act No. 408/2000 Coll., on the Protection of Plant Variety Rights, as amended and Council Regulation(EC) No.2100/94 on Community plant variety rights, as amended. The use of the protected variety by a third person is possible only on the consent provided by the holder of the breeder’s rights under the breeder’s licence.
The only exception species forth in Annex to this Act, a grower is authorized to use farm saved seed without the consent of the holder of breeder’s rights, it means propagating material from his own harvest. The use of farm saved seed is conditioned by fulfil prescribed requirements by the law and pay remuneration.
